This privacy policy ("Privacy Policy") is intended to provide you with specific details about how Henlay Co. d/b/a My Pet Chicken ("MPC," "we," and "us") collects and processes your personal and personally identifiable information through your use of the Website and associated services ("Website"). MPC determines the purposes and means of processing the information collected through the Website.

You understand and agree that MPC may store and process your personal information on computers located outside of the European Union, including, but not limited to, in the United States. By using the Website, you agree to the collection and processing of your personal or personally identifiable information outside of the European Union.

Before using the Website or providing information to us, please carefully review this Privacy Policy. By using or accessing the Website, you agree that we may collect and use your personal and personally identifiable information in accordance with this Privacy Policy, as revised from time to time. MPC may modify, amend, replace, or suspend this Privacy Policy at any time. By providing MPC with your personal or personally identifiable data and using the Website, you warrant that you are over the age of eighteen (18) or otherwise above the age of majority within your jurisdiction. If you are younger than eighteen (18) or the age of majority within your jurisdiction, please do not use the MPC Website and please do not provide personal information to us.

Personal Information Collected

When you use the Website, we may collect personal or personally identifiable information from you ("PII"). PII may include any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. It does not include anonymized data.

We may collect and process the following categories of PII about you:

  • Communication Data. Communication data includes any communication that you may send to us, or that we exchange with you, through the website, email, social media, chat, text message, or telephone, including recordings of telephone calls and voicemail messages; written transcripts, short summaries, and tone or sentiment scores of those calls and messages generated using automated (artificial-intelligence) tools; and related call metadata such as date, time, duration, and the phone numbers involved. We process this data to communicate with you, to provide you with customer support, to record logs of our communication, to train and evaluate our customer-care team and improve service quality, to conduct internal research and analytics, to develop, test, train, and improve our services, systems, and the automated tools we use to provide them, whether in original, de-identified, or aggregated form, to resolve billing disputes and chargebacks, and to store information to respond to legal claims.
  • User Data. User data includes data about how you use the Website and any data that you post to or authorize through the Website. This includes data stored in persistent cookies when you login to the Website and analytics data that is collected when you use the Website. We collect and process this data to operate the Website, to authenticate you as a user of the Website, to make sure that timely and relevant content is provided to you, to secure the Website, to keep the Website operating quickly, and to maintain backups of the Website.
  • Technical Data. Technical data includes data about your use of the Website, such as your IP address, your login data, your phone number, your mobile device model, your operating system, your geolocation, and your time zone. MPC may collect this data from your use of the Website and from advertising IDs. MPC processes this data to analyze your use of the Website, to route Website traffic, to administer and secure the Website, to provide location-relevant content, and to troubleshoot problems with the Website.
  • Marketing Data. Marketing data includes data about your preferences in receiving and interacting with MPC's advertisements or content on the Website. MPC collects this data from your use of the Website and from advertising identifiers created through advertising programs operated by Google, Meta, and Apple. MPC does not connect advertising identifiers to persistent device identifiers, such as MAC addresses or mobile device IDs. MPC uses this data to advertise its products, including remarketing advertisements shown to you on other websites and services.
  • Personally Sensitive Data. Personally sensitive data includes data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, union membership, or information about your health. MPC does not intentionally collect personally sensitive data through the Website and does not use it to make decisions about you or to market to you. Communications you send us, including recorded calls, may incidentally contain sensitive information you choose to share. We use that information only to handle your request, and we do not use it for the purposes that would give you a right to limit its use under California law.

Call Recording, Transcription, and Monitoring

When you call us, or we call you, we may record the audio of the call. We tell you the call is recorded at the start of the call, before recording begins. On calls you place to us, continuing through the automated menu and making a selection indicates your consent to being recorded.

We use automated artificial-intelligence tools to generate a written transcript, a short summary, and a tone or sentiment score of the call, together with call metadata such as date, time, duration, and the numbers involved. We apply the same transcription to voicemail messages you leave for us. We do this to handle and resolve your order or inquiry, to train and evaluate our team and improve service quality, to resolve billing disputes and chargebacks, to keep a record of what was discussed, to help protect the security of your information, and to conduct research and to develop and improve our services and the automated tools we use.

Service providers. To perform transcription and this analysis we use a third-party artificial-intelligence service provider, and we store call audio with a third-party cloud-infrastructure provider. Under the terms that apply to our use of the transcription service, call content is not used to train artificial-intelligence models. The provider retains the content it processes in encrypted form for a limited period for abuse monitoring, and then deletes it. Call content is processed solely to produce a transcript, summary, and tone score for us.

Voice data. We do not use call recordings to identify you by your voice, to authenticate you by your voice, or to create a voiceprint or any other biometric identifier.

Payment card information. We take measures intended to keep payment card information out of recordings and transcripts. Our team is instructed to stop recording while taking payment, and we run automated monitoring designed to detect payment card numbers in transcripts. When the monitoring identifies a payment card number, our staff review and delete the affected record, which removes the transcript and the associated recording together. This monitoring is used only to protect your information. It is not used to make decisions about you or to build a profile of you.

Security and access. Call recordings are stored encrypted at rest, and call data is encrypted in transit to our service providers. Access is limited to authorized personnel with a business need.

MPC will only use your PII for the purpose for which it was collected. In the event that MPC needs to use your PII for an unrelated new purpose, MPC will provide you with notice of this new use and will explain the basis for such processing. MPC may process your PII without your knowledge or consent where required or permitted by law.

MPC does not use your PII to create an automated profile about you. The automated tools we use on calls and voicemail messages, which transcribe, summarize, score call tone for quality purposes, and detect payment card numbers for security purposes, do not make decisions that produce legal or similarly significant effects about you. Any action taken as a result is taken by our personnel.

Cookies and Tracking Technologies

MPC may collect data about you through cookies and other technologies. This helps MPC understand how you use the Website and any patterns associated with your use of it. This aids MPC in developing or improving its Website in response to your needs.

MPC may use session or persistent cookies. Session cookies are only stored on your device during your use of the Website and are automatically deleted when you close your browser. Persistent cookies remain on your device after you close your browser and can be read by the website that created them when you return.

We use these technologies in the following categories:

  • Strictly necessary. Required for the Website to function, including cart contents, currency and localization, checkout, and security. These cannot be turned off.
  • Analytics. Google Analytics 4, used to understand how visitors find and use the Website.
  • Advertising. Google Ads, including remarketing, and the Meta pixel, used to measure advertising performance and to show you our ads on other websites and services.
  • Functional. Klaviyo for email and SMS marketing, Swym for wishlist features, and Reviews.io for product reviews.

If you visit from a state where we require consent, you will see a banner before any analytics or advertising technology loads, and nothing outside the strictly necessary category runs until you choose. You can change your choice at any time through the "Your Privacy Choices" link in the footer of every page.

MPC may also receive data from third parties including analytics providers or advertising networks such as Google, Meta, or Apple. These third parties may be based outside of the European Union.

Marketing Communications

MPC may send you marketing communications if you have asked for information concerning its goods or services, or if you have agreed to and have not opted out from receiving marketing communications. You may ask MPC to stop sending you marketing messages at any time by logging into the Website to adjust your marketing preferences within your User Account, by following the opt-out link in any marketing message, or by replying STOP to any text message. If you opt out of receiving marketing communications, your opt-out does not extend to PII provided for other purposes, and it does not stop transactional messages about orders you have placed.

Disclosure of Personal Information

MPC may share your PII with the following parties:

  • Service providers that provide MPC with information technology or other administrative services;
  • Payment processors, which collect and process payment card details directly;
  • Shipping and fulfillment partners, which receive your name, address, and order contents;
  • Third-party artificial-intelligence service providers that transcribe and analyze call recordings and voicemail messages, and telecommunications and cloud-infrastructure providers that carry and store them, as described under "Call Recording, Transcription, and Monitoring";
  • Advertising and analytics partners, as described under "Cookies and Tracking Technologies" and "Sale and Sharing of Personal Information";
  • MPC's accountants, auditors, insurers, or attorneys;
  • Law enforcement agencies upon the receipt of a subpoena or court order or where necessary to protect MPC's personnel or property; and
  • Government bodies that require MPC to report its processing activities.

For customers who reside in the State of Connecticut and order baby chicks, we are required under Connecticut law to share the following information with Connecticut's Department of Agriculture, and we will do so upon confirmation of an applicable order:

  • First name
  • Last name
  • Mailing Address
  • Number of chicks purchased
  • Date of order

MPC may also transfer PII to third parties when it sells, transfers, or merges any part of its business or assets.

MPC requires all third parties that receive a transfer of PII from MPC to maintain the same level of protection for PII as MPC, and MPC only allows third parties to process your personal data for the specific purposes listed in this Privacy Policy.

Sale and Sharing of Personal Information

Under California law, disclosing personal information to advertising partners for cross-context behavioral advertising is treated as "sharing," and in some cases as a "sale," even when no money changes hands.

We share personal information for cross-context behavioral advertising. Specifically, we share online identifiers, IP address, and browsing activity with Google and Meta so that our advertisements can be shown to you on other websites and services.

Categories shared in the preceding twelve months: identifiers, internet and other electronic network activity, commercial information consisting of products viewed and purchased, and approximate geolocation derived from IP address.

We do not sell or share personal information for money, and we do not sell or share the personal information of anyone we know to be under 16 years of age. We do not sell or share call recordings, transcripts, or voicemail content.

Data Security

MPC has put into place data security measures to protect your PII. MPC allows access to your PII only by employees and service providers who have a need to know or on MPC's instructions. However, no security measures are impenetrable and there are always security risks. MPC will notify you and any regulatory body of any breach of your PII or MPC's security measures if it is legally required to do so. Call recordings are stored encrypted at rest, and call recordings and transcripts are encrypted while transmitted to our service providers.

Retention of Data

MPC will only retain your PII for so long as necessary to fulfill the purposes for which it was collected under this Privacy Policy, or for the purposes of satisfying any legal, accounting, or reporting requirements. We will also retain and use your PII to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Call recordings are subject to an automated deletion schedule and are deleted approximately six months after the call.

Call transcripts, summaries, tone scores, and related call data are retained for up to thirty-six (36) months, and then deleted. Recordings and transcripts are kept on separate schedules, so deleting a recording does not delete the transcript made from it.

Backups. Copies of this information may persist in routine system backups for a period after deletion from our active systems.

MPC may retain a recording or transcript longer where it is relevant to a pending dispute, claim, or legal obligation.

Our service providers retain the data they process on our behalf only temporarily, as needed to perform their services for us and as described under "Call Recording, Transcription, and Monitoring."

Your Privacy Choices

Opt out of sale and sharing. Use the "Your Privacy Choices" link in the footer of every page. This stops us from sharing your information for cross-context behavioral advertising on the browser and device you use to submit the request.

Global Privacy Control. We honor the Global Privacy Control (GPC) signal. If your browser or extension sends GPC, we treat it as a valid opt-out of sale and sharing for that browser automatically, with no further action needed from you.

Consent banner. If you visit from a state where we require consent, you will see a banner before any analytics or advertising technology loads.

Marketing. Use the unsubscribe link in any email, reply STOP to any text message, or update preferences in your account.

Browser controls. Most browsers let you block or delete cookies. Blocking strictly necessary cookies may prevent checkout from working.

Interest-based advertising. To learn more about interest-based advertising across websites and additional opt-out choices, you can visit http://optout.aboutads.info. Even after opting out, you may still see advertisements that are not tailored to your interests.

Your Rights

Depending on where you live, you may have the right to:

  • Know what personal information we have collected about you, the sources, the purposes, and the categories of recipients
  • Access a copy of your personal information in a portable format
  • Correct inaccurate personal information
  • Delete personal information we hold about you
  • Opt out of sale, sharing, and targeted advertising
  • Limit the use and disclosure of sensitive personal information. We do not use sensitive personal information for purposes that would give rise to this right
  • Non-discrimination. We will not deny service, charge a different price, or provide a lesser quality of service because you exercised a privacy right

To verify your request, we may request certain information from you to confirm that you are an MPC customer, such as your phone number, email address, city, state, or geographic location. We will respond within forty-five (45) days and may extend once by an additional forty-five (45) days where permitted, and will tell you if we do.

Authorized agents. You may designate an authorized agent to make a request on your behalf. You must provide MPC with proof that the individual or business has been appointed as your agent, such as a signed power of attorney, and we may contact you directly to confirm.

Appeals. If we deny your request and your state provides an appeal right, reply to our decision with the word "Appeal" and a brief explanation. We will respond in writing within the period your state requires.

Access to call recordings and transcripts. Requests to access or delete call recordings and transcripts are subject to the retention schedules above and to the technical limitations of the systems that hold them.

California Privacy Rights

The following applies to residents of the State of California. California residents have the right to be notified which categories of PII are being collected and the purposes for which the PII is being used. We collected the following categories of PII (A, B, D, F, and H) as defined in the California Consumer Privacy Act within the last twelve months. Our uses of this PII are detailed above in this Privacy Policy:

We obtain these categories of PII directly from California residents when they complete forms through our Website, call us, or provide information to us as part of a transaction or inquiry concerning our products. We also obtain these categories indirectly while observing their actions on our Website and from third parties or service providers that they have authorized to receive and share PII.

California residents have the rights described under "Your Rights" and "Your Privacy Choices" above, and have a right not to receive discriminatory treatment for exercising them.

Other State Privacy Rights

Residents of other states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Rhode Island, Indiana, and Kentucky, have rights under those laws that are substantially similar to those described under "Your Rights" above, subject to each state's own terms and thresholds. Use the same contact method to exercise them.

Nevada Residents

If you are a resident of Nevada, you may provide notice to us to limit the sale of your PII to third parties for resale or licensing purposes. However, we do not sell your PII for such use. To notify us that you wish to limit the sale of your PII to third parties for resale or licensing purposes, you may send us an email at flockcare@mypetchicken.com with the subject line "Nevada Do Not Sell Request," along with your name, address, and user account information.

Third Party Links

MPC's Website may include links to third-party websites and applications. By clicking on third-party links, you may allow third parties to collect or share data about you. MPC does not control these third-party links and you are advised to review their respective privacy policies.

Children's Privacy

We do not direct the Website to anyone under the age of 13 and we do not knowingly collect PII from anyone under the age of 13. If you are a parent or guardian of an individual under the age of 13 and believe that we may have collected PII from your child, please contact us at flockcare@mypetchicken.com.

Notification of Changes

Whenever MPC changes its Privacy Policy, we will post those changes to this Privacy Policy on the Website and other places that we deem appropriate. Your continued use of the MPC Website following these changes indicates your acceptance of the practices described in the revised Privacy Policy.
